Is Your Attic "Legal"? The First Step Before Finishing Your Attic

A client recently contacted us with a common request: "I have an empty attic, and I want to turn it into a legal bedroom." It sounds simple enough. But before we price the drywall or design the layout, we have to answer the most important question: Is it feasible?

The "Staircase Challenge" For this specific project, our initial inspection revealed two major red flags with the existing staircase leading up to the attic:
Width: The stairs were narrow—less than the standard 36 inches.
Headroom: The clearance walking up the stairs was tight—less than the required 6 feet, 8 inches.
In new construction, neither of these would pass inspection. This left us with a difficult question: Do we have to rebuild the entire stairwell?
Consulting the Building Department We immediately took these measurements to the local Building Department to discuss the options. This is where hiring an experienced General Contractor pays off.
The Verdict:
The Width (Saved): Because it is an existing condition in an older home, the town agreed to let us keep the existing narrow stair width. This saved the client thousands of dollars in structural framing work.
The Headroom (Must Fix): However, safety is non-negotiable. The building inspector insisted that we must achieve the minimum 6'8" headroom. You cannot have people hitting their heads in an emergency exit path.
The Solution: Building a Dormer Since we couldn't lower the stairs, we had to raise the roof. To get that required 6'8" clearance, our proposal now includes building a shed dormer over the top of the staircase.
This solves two problems at once:
Code Compliance: It legally provides the headroom required for a bedroom.
Comfort: It opens up the staircase, making the transition to the new third floor feel spacious and welcoming rather than cramped.
The Lesson Never assume an attic can be finished just because there is space. Code requirements for egress, light, ventilation, and stairs are strict.
